Trademark Examination Time at All Time Low

The United States Patent and Trademark Office (USPTO) stated in its newsletter that pendency had hit an all time low.  "Pendency for trademarks ... continues at historically low levels ....  First action pendency has maintained a 2.5 – 3.5 month range."

The USPTO's Trademarks Dashboard graphically displays the times.

For applicants, this means quick determination and establishment of trademark rights.

USPTO Announces Trademark Dashboard

The United States Patent and Trademark Office (USPTO) announced the launch of the Trademarks Dashboard.  The Trademarks Dashboard provides a graphical view of the Trademark Office's workflow.

What I take from the data is that the USPTO is doing a pretty good job processing applications:

  • First actions 2.7 months after filing;
  • Average pendency of 10.9 months;
  • 112,970 Registrations issued this year
  • 189.064 applications filed

Remember that trademarks can be more than just names and logos.  Non-Traditional Trademarks can be packaging and product configuration, sounds, colors, and tastes that consumers use to identify the maker of a given good or service.
