USPTO Will Remain Open During Shutdown

The United States Patent and Trademark Office (USPTO) will remain open at least temporarily even if there is a government shutdown.  Even if a shutdown occurs, the USPTO has enough reserves to remain open through April 18, 2011, without a reduction in services. 

If the shutdown remains in effect past April 18, then the USPTO will cut services to the minimum.  The USPTO will still accept new applications and filings and will maintain the IT infrastructure but will not be performing substantive work.

So, for clients, a short shutdown will not affect examination.

If the shutdown extends past April 18, 2011, then Examination times will be affected.
