Patent Reform in the State of the Union

And let’s pass a patent reform bill that allows our businesses to stay focused on innovation, not costly, needless litigation.   -- Barack Obama, 2014 State of Union.

Patently-O provided a list of pending patent legislation in 2013.

The leading candidate appears to be the "Innovation Act," which was introduced by Representative Bob Goodlatte (R-VA) as H.R. 3309.  The bill passed the House and is awaiting review in the Senate.  Text and status of the bill are available online.  A useful summary was provided by Patently-O.

The Innovation Act is targeted at hindering patent trolls.  Changes include the following:

  • Attorneys' fees awards to prevailing parties in patent disputes;
  • More specific pleading requirements; and
  • Simplified discovery in patent disputes.

Let's finish this post like the president finished his speech:

Believe it.

God bless you, and God bless the United States of America.
